Establishing a Clear Rule for Reporting Contributions to Multi-Purpose Groups

Staff of the Fair Political Practices Commission will be holding an interested persons’ meeting to elicit public input on possible Commission action to implement a recommendation by the Chairman’s Task Force on the Political Reform Act (Government Code Sections 81000 – 91014; hereafter, the “Act”).

The final report of the Chairman’s Task Force, presented to the Commission at its January 2011 meeting, included a recommendation that the Commission consider a regulation relating to campaign reporting by “multi-purpose” organizations. This recommendation is found in Part II, paragraph 3.E. on page three of the final report and reads as follows:

E. Revise FPPC rules for campaign filings by multi-purpose organizations so that there is a single standard and clear transparency in reporting the donors to the organizations. We recommend that the Commission consider a last-in, first-out (“LIFO”) formula for identifying a multi-purpose organization’s donors.

The Act defines the term “contribution” (in pertinent part) as a payment made for a political purpose, which can include many kinds of payments to a multi-purpose organization – for example, payments responding to an appeal soliciting “donations” to fund an advertisement supporting a measure in an upcoming election. By contrast, “donations” to such groups that are not made for a political purpose, and are not used for a political purpose, are not “contributions.”

Staff understands this Task Force recommendation as calling for the creation of a clear accounting rule to be used for identifying donations to multi-purpose groups that are classified as “contributions” under the Act’s “one bite of the apple” provision at Regulation 18215(b)(1). The Commission would therefore welcome public comment on the following topics:

What kinds of organizations should be covered by the proposed regulation? Are they limited to non-profit organizations, such as IRC Section 501(c) corporations, or do other forms of multi-purpose groups also raise and spend money to influence state and local elections in a manner that would trigger reporting obligations under Regulation 18225(b)(1)?

Will multi-purpose groups with reporting obligations under Regulation 18215(b)(1) accurately identify and report contributors supporting their political activities by using a LIFO accounting method? If not, what alternative would promote more accurate reporting?

Do differences in organization, membership, size, sophistication, or other characteristics or circumstances complicate the use of a single clear rule for identifying contributors to various kinds of multi-purpose groups?

If the answer to the preceding question is “yes,” how can such a rule be framed to yield accurate identification of contributors to all multi-purpose groups with reporting obligations? Are there alternative rules, or sets of rules, that would ensure that every multi-purpose group knows and will apply an accounting method that properly identifies the group’s reportable contributors?

FPPC Selects Audit Targets

FPPC selects entities for audit by the Franchise Tax Board, as part of a regular system of audits. Entities are selected by lottery.

The lottery selections on February 1, 2011, included the following entities:

  • Equality California
  • Kaiser Foundation Health Plan, Inc.
  • Pacific Gas and Electric Company and its affiliates
  • Sierra Club

The Line Forms Here…The reports are in on lobbyists’ contacts with San Francisco City officials, and you have to wonder if some of them ever had time to meet with the people who actually elected them. Board of Supes Prez David Chiu, by CitiReport’s count, reportedly met 188 times with lobbyists last year – and that’s just the officially registered lobbyists, not self-important manipulators like Rose Pak or Willie Brown, both of whom managed to fatten their wallets by dint of influence peddling.

How seriously can we take these lobbyist contact reports at the Ethics Commission web site? The February 15 reports, covering the month of January, reveal that lobbyists did not report a single contact with the mayor’s office, the board of supervisors, the city attorney or anyone else regarding the appointment of an interim mayor. Believe it if you can. We can’t.

Swag…City officials have to report the gifts they received when they file their Statement of Economic Interests, which they do when leaving office, assuming office or when annual reports are due. The cap last year was about $420 dollars total from any one source, which is intended to keep the swag to reasonable levels. Some gifts don’t have to be reported at all if they are “re-gifted” within 30 days, which makes for a nice gesture to hard-working staff when you suddenly find yourself with five fondue pots.

Departed former mayor Gavin Newsom reports pages of received gifts, more than all the supervisors combined, so he takes the Swag Grand Prize for 2010. We’re not talking Starbucks coffee gift cards here. Among those giving Hizzoner swag was Nicola Bulgari, as well as the head of Tiffany’s here in town. And then in a nice bit of financial jiu-jitsu, Newsom received free tickets to the San Francisco Opera Gala, the San Francisco Symphony Grand Opening, and various other entertainment venues such as Opening Day at the San Francisco Giants. Nevermind that those groups all received either city funding or city permits from Hizzoner during the same period. After all, it’s kind of a family thing.

As one might guess, there is usually an outlier of some kind among the lists of gift-givers. A Luis Vuitton pen valued at $395 was given to Newsom on November 10 after he safely won election as Lieutenant Governor, from one Dmitry Roboloviev. Who dat? If Newsom has correctly identified the source, that would be the man listed as the sixth richest man in Russia, who plunked down $100 million cash to buy Donald Trump’s Palm Beach estate, another $100 million for his yacht, plus a DC319, plus beginning work on a replica of Marie Antoinette’s Petit Trianon on the shores of Lake Geneva, Switzerland. He also was known to have been housed in a Russian jail for 11 months facing a charge of murdering his business partner back in 1996, although the charges were dropped because of a lack of evidence.

CitiReport would have checked Newsom’s report against the one he had to file when he assumed office as Lt. Governor, but the FPPC web site where that data is posted still doesn’t show a report from the Scion of Sacramento.

And, in a small amendment, Mayor Ed Lee has noted that last year he did receive a bottle of win valued at $49.99 from then-mayor Newsom.

A Decoder Ring in Every Box…Ethics Executive Director John St. Croix tells CitiReport that we failed to use our Decoder Ring to decipher the secret key on whether Ethics had scrubbed mention of former District Attorney Kamala Harris’s missed deadline for her leaving office filing. The Ethics Commission list of Statements of Economic Interests lists only those that have been filed. There is a small box that a citizen can check that states “include Non-Filers in Search.” Apparently “Non-Filers” is the code phrase to pull up folks who didn’t file but were supposed to. Harris, by the way, eventually did file and her report can be seen on CitiReport’s “In-Out” file drawer.

Lobbyist for Waste Management’s interest in San Francisco garbage contract questioned on lobbyist registration, Competitor Recology expresses its doubts about it all. http://www.sanfranciscosentinel.com/?p=107856

San Francisco launches web-based data on registered lobbyists in a system much improved over the past, but which is faulted for failing to link lobbyists and campaign contributions for easy access. ““Everything is always a work in progress,” St. Croix is quoted as telling SF Public Press. “This is all we have for now. If it turns out there is a demand for something, we can come up with ways to provide it.”

Ethics Not Following The Money

Firefighters and police officers are among those not filing disclosures of moonlighting jobs, despite a city law that requires the reports. The law is intended to thwart conflicts of interest. Ethics Refers 13 groups for overdue fines

Johnny Wang,  providing political consultant services under the name  JKW Political Consulting, $4,000 settled stipulation for seven violations of failing to report his work as a campaign consultant from 2007 to 2010. By the SF Ethics Commission. Dec 13, 2010

Glendon “Anna Conda” Hyde, $150, Dec. 13, 2010 for  failing to include “paid by” on an ad in the Central City Extra in a campaign for District 6 supervisor in 2010.

Dean Clark, $76, December 13, for  failing to include “paid by” on an ad in the Central City Extra in a campaign for District 6 supervisor in 2010.

John Rahaim, Planning Director, $1,000 on July 12 for accepting free rent for one month valued at $2,200 by Rahaim while the ceiling on gifts from a single source was $390 in 2008. The free rent was provided by the father of an employee in Rahaim’s department. Mitigation factor was that he needed a place to live after a fire made his city-provided housing uninhabitable and he was in personal crisis.

Ethics reports that it has referred to collections 13 campaigns for delinquent payment of fines and penalties for a total of $22,022, dating from 2006 through 2010. Included: Bill Barnes for Supervisor (2008 with current balance reported of $1041.00), Care Not Cash (2008 for $5,331 with $2,731.00 remaining). The largest debt is Manuel Valle for Treasurer, 2007, for $5,525.00 (last updated February 2011)
